Bargaining Rights are HUMAN Rights

In the focus on the fight to preserve collective bargaining rights for public employees in Wisconsin, Ohio, Indiana and elsewhere, the mass media has ignored the international and human rights significance of these battles.

Under international labor law, the right to collectively bargain is considered a fundamental human right. Legislation or executive action to eliminate collective bargaining rights is, therefore, a violation of international law.

Under the Universal Declaration of Human rights (adopted in 1948 by the United Nations), to which the United States is a signatory, the right to bargain collectively is subsumed under the rights to freedom of association and the right to organize into a trade union (Articles 20 and 23). Since the Declaration has been signed and ratified by the United States it is therefore binding on state governments through the Supremacy Clause of the Constitution (Article VI, clause 2).

The right to organize and bargain collectively is explicitly covered under International Labor Organization Convention 98 adopted in 1949. While the United States has not specifically ratified ILO Convention 98, it is bound by that Convention by virtue of its membership in the ILO, as these rights are part of the ILO charter and, therefore, stand above the individual Conventions.

A 2007 decision by the ILO sustained a complaint filed by the United Electrical Workers against the State of North Carolina for its prohibition on collective bargaining for public employees. The ILO called on the United States to "promote the establishment of a collective bargaining framework in the public sector in North Carolina," and called specifically for the repeal of North Carolina General Statute §95-98, the state law that prohibits public employee collective bargaining. Currently pending before the ILO is a complaint filed by Transport Workers Local 100 challenging New York State's "Taylor Law," which prohibits strikes by public sector employees.

Finally, as a result of many years of advocacy on the part of human rights and labor groups, the "violation of internationally recognized labor rights" is now typically included as a prohibition in trade agreements that the United States enters into with other nations.

So while anti-labor forces in the United States have chastised Democrats in the Wisconsin Senate for leaving the state as an anti-democratic move, in truth these Senators are serving as the last line of defense of internationally recognized human rights and, therefore, of democracy.

Recent polls indicate that a clear majority of the American people support collective bargaining rights -- not because they belong to unions, which most do not, but because it is a simple issue of fairness and democracy.

It was not too long ago that both Republicans and Democrats used the lack of bargaining rights in the former Soviet Union as clear evidence of totalitarianism. What does it say about today's Republican Governors that they are making the elimination of collective bargaining their signature issue?

I just finished my Master's this fall with an emphasis in global human rights. I've been screaming to everyone who would listen that this is a bigger deal than just pensions and health insurance, yet it took 29 days before a large enough media outlet pointed that out.

But you know what really pisses me off? If this was any other country than the US, we'd be all over this. Amnesty International would be all over it. You name it, that country would be vilified. Do we need to hit rock bottom and declare ourselves Third World in order for anything to get done about this? J/C!

Gov. Walker & WI GOP Continue to Harass 14 Dem Senators From Across State Lines



Ed Schultz just had Wisconsin State Senator Lena Taylor on his radio show, and apparently Governor Walker and his GOP lackeys in the State Senate are continuing to harass and intimidate the Senators, who are still out of reach across the state line in Illinois.  What's more, they are extending that intimidation and harassment to their staff members still at the Capitol, as well as their constituents by interfering with the Senators' ability to continue to work on constituent cases.

 

Governor Walker has continued to infringe upon Wisconsin protestors' First Amendment rights by closing off the Capitol building to all except those who have appointments with legislators, or other "official" business.  This action is in violation of the Wisconsin State Constitution (Article I, §4 – ANNOT. The legislature cannot prohibit an individual from entering the capitol or its grounds. [59 Atty. Gen. 8.])

Word has it that a lawsuit has been filed in US District court against the state for violating this law of access to the building.

But the Governor and the WI GOP's strategy to get their way extends even beyond closing the People's Capitol Building, or pulling legislative dirty tricks such as a 1am vote that lasted only seconds.  They have continued to harass and intimidate the 14 Democratic Senators, their staff members, and even their friends and fellow churchgoers to put as much pressure as possible on them to return.

While the Dem Senators of Wisconsin are indeed outside of the state, they are still continuing to do their jobs remotely, working in conjunction with their offices in the Capitol Building, and their staff members to serve their constituents.  Contrary to what Gov. Walker would have you believe, they ARE doing their jobs, and not exactly kicking back with mai tais around the hotel pool.

But, the Governor and the GOP state legislators are doing everything in their power to even sabotage those efforts.  Senator Lena Taylor listed a number of things that have been happening in recent days, but I have seen little to no media coverage of:

- The Governor has been withholding the Senators' paychecks, something that Sen. Taylor claims is illegal for them to do to any state worker.

- GOP Senator Fitzgerald will not allow the Dem 14 to authorize the paychecks of their own staff members who continue to work, but instead they must be authorized by Fitzgerald himself.  No details yet on what staff members must do in order to obtain that authorization, but I'll update this if I get further information.

- They are now preventing the Dem 14's staff from using Capitol office equipment to such everyday things like printing and scanning documents needed in order to do work on constituent cases.  They must instead have any of that done through the Clerk's office, who in turn CHARGES for those services back to each of the Senators' offices.

- Police Officers were dispatched to Sen. Taylor's church on Sunday morning before services, to question the parishoners as to the exact location and whereabouts of Senator Taylor and her colleagues.

The word "petty" doesn't seem base enough to describe these tactics or harassment and intimidation, and the Wisconsin members of the GOP and its Governor don't seem to care who gets hurt in the process whether its the Dem Senators, their hard working staff, or the constituents in the districts that these Senators represent in the State of Wisconsin.

UPDATE 1:  Confirmed by Ed Schultz just now on-air, the AFL-CIO's blog is reportingthat they are now WELDING THE WINDOWS OF THE CAPITOL BUILDING SHUT in order to prevent workers from passing food in to those who are still left inside the Capitol building. AFL-CIO attorneys are collecting affidavits from those who witnessed this happening, and are pursuing a temporary restraining order (TRO) to prevent them from closing off the building.

Another commenter asked if this might constitute a fire hazard, and I'd welcome any comments on that from those familiar with fire safety requirements for public buildings.

A call for INJUNCTIONS!

Police are now beginning the attempt to clear the Capitol Building.  If no injunction is being served, we can at least scream for an injunction on any following attempts to keep the Capitol closed, any attempts to prohibit sleeping bags, access to hygiene, food, communications, etc.  The people at the Capitol are expressing uninfringeable, Constitutional rights.  There is no justification for limiting or excluding them, based on merely "cleaning the building".  So, I urge people to start tweeting for some INJUNCTION alternative, ASAP - I don't think a wait-and-see attitude would be appropriate - it needs to start ASAP, even if the Police DO end up allowing everyone back in, w/o limitation.

Every legal option needs to be pursued in this, and other matters, such as the illegal harassment of the homes and families of the 14 Senators.  The Governor is already planning legal battles against us.  I think cases can be made, from all violations combined, if not from each on it's own merits, that this Governor - (and accomplices) - is acting illegally.  I'm sure there must be some way he could be arrested - and a violation of any injunctions would provide such a reason.  Injunctions need not provide full evidence or argument defining a threat or danger.  Many of them simply need a sympathetic Judge, who senses some legal validity potential.
