Monopoly Over Violence

The Roman Empire appears as a massive structure provided with the most impressive administration and army known in Antiquity. Unfortunately, Rome could not provide the overall security that provincial population demanded because of its inherent limitations. In consequence, provincials had to provide themselves with their defence. This paper deals with this necessity and the resources used to counter the menaces that the State could not face and the implications arisen from this reality, in particular in the Later Empire.

In this article, I deconstruct the concept of legitimacy (notably in the form elaborated by Max Weber) by emphasising its conceptual complicity with the notion of sovereignty. Through an analysis of Derrida's critique of Austin's theory of performativity, I elaborate another, non-ontological 'concept' of legitimacy, located before and beyond sociological methodology, International Relations theory, and performative ontologies of power. This legitimation-to-come signifies the structural fallibility and pervertibility of the performative, and instantiates the archi-originary force of an unconditional resistance, conditioning both the position and the deconstruction of ontologies of sovereign ipseity (ipsocracy). Pursuing the efforts of Cynthia Weber and Rob Walker, I attempt to sketch the implications of this post-performative legitimacy with respect to the protocols of legitimation of International Relations theory and sociological methodologies, through an analysis of their persistent ontological presuppositions.

In this article, I engage with Derrida’s deconstructive reading of theories of performativity in order to analyse Max Weber’s sovereignty/legitimacy paradigm. First, I highlight an essential articulation between legitimacy and sovereign ipseity (understood, beyond the sole example of State sovereignty, as the autopositioned power-to-be-oneself). Second, I identify an originary force of alteration, an unconditional deconstructibility of sovereignty, foreign to the order of performative legitimacy. This disjunctive force implies an essential fallibility of the performative. The differential co-implication of legitimacy and sovereignty suggests an irreducible coloniality of law and language, but also points to an unconditional resistance located in the radical interpretability of the law, beyond determined positions of powers, dominations, sovereignties or resistances.
My reflection is triggered by a reading of Cynthia Weber’s theory of ‘performative states’, describing sovereignty under the form of an impossible ontology, which leads me to elaborate the notion of legitimation-to-come as a non-ontological ‘concept’: this unconditional legitimacy, beyond sovereignty, binds beliefs and phantasms to the unpresentable force of the event. Pursuing the efforts of scholars such as Rob Walker and Cynthia Weber, I sketch the implications of this archi-performative force of legitimacy with respect to the methodologies of International Relations and sociology, in view of elucidating the persistent ontological presuppositions of these disciplines.

In der üblichen Periodisierung der Weimarer Republik beginnt mit dem Jahr 1924 die Phase ihrer ‚relativen Stabilisierung‘. Nach der Überwindung der Hyperinflation 1923 ist dies meist wirtschafts- und sozialpolitisch gemeint, oft auch in Hinblick auf die Innenpolitik oder die Kunst und Kultur. Vernachlässigt wird dabei allzu oft, dass diese Stabilisierung vor allem zunächst sicherheitspolitischer Natur war. Die harten Anfeindungen von rechts und links gegen die Republik und die politische Gewalt ebbten merklich ab, die Republik hatte sich gegen ihre Feinde behauptet.
Das war nach Ausbruch der Revolution im November 1918 keinesfalls selbstverständlich. Der Zusammenbruch der alten Ordnung war noch relativ friedlich verlaufen. Auch hatte sich die Übergangsregierung schnell der Loyalität des Heeres und der anderen Sicherheitsbehörden versichert. Doch bald brachen auf linker Seite gewaltsame Auseinandersetzungen über die Richtung der Revolution aus, wie die Dezember- und Januarunruhen 1918/19 oder später auch der Ruhraufstand 1920 und der „Deutsche Oktober“ 1923 zeigten. Auch im rechten Spektrum war die Bereitschaft zum gewaltsamen Vorgehen gegen Revolution und Republik schnell geweckt. Neben rechtsradikalen Attentaten auf demokratische Politiker wie Erzberger, Scheidemann und Rathenau bildeten 1920 der Kapp-Lüttwitz- und 1923 der Hitler-Ludendorff-Putsch die Höhepunkte rechter Angriffe auf die Republik. Neben verschiedenen sezessionistischen Bestrebungen hatte die in der Revolution geborene Republik zudem mit einem drohenden Verlust des staatlichen Gewaltmonopols zu kämpfen: Freikorps verschiedener Couleur, auf Eigenständigkeit pochende Soldatenräte, Stadt- und Bürgerwehren, unkontrolliert zirkulierende Kriegswaffen, paramilitärische politische Verbände – all das waren erhebliche Herausforderungen für die Akteure des staatlichen Gewaltmonopols, das sich zudem gerade in der Transformation von einem obrigkeitsstaatlichen zu einem demokratischen Gewaltmonopol befand.
Vor dem Hintergrund dieser Herausforderungen ist die Konsolidierung des demokratischen Gewaltmonopols beachtlich. Die Konferenz fragt nach dem Wechselspiel zwischen gewaltsamer Anfeindung und Konsolidierung, aber auch danach, was diese gewaltsame Geburt der Republik für ihre politische Kultur bedeutete und wie diese Gewalterfahrungen verarbeitet wurden.

Il contributo pone in questione la definizione dello Stato come istituzione (Anstalt) che detiene il monopolio dell’uso legittimo della forza/violenza (Gewalt), e si articola in tre parti. Nella prima, ci si confronta con alcuni essenziali riferimenti di bibliografia secondaria sull’espressione in oggetto. Nella seconda, si focalizza l’uso che Weber fa di “monopolio” all’interno delle sue opere, con l’intento di mostrare come l’espressione “monopolio dell’uso legittimo della violenza/forza” possa essere meglio compresa se concepita come un uso specifico di “monopolio” all’interno della ben più ampia casistica weberiana. Nella terza parte viene analizzata l’importanza del richiamo al monopolio della Gewaltsamkeit all’interno della cosiddetta Considerazione intermedia, che è stato finora meno considerato. Si ritiene che fornire alcune indicazioni sul senso che l’espressione ha all’interno di questo testo possa essere d’aiuto per afferrare meglio alcuni aspetti del suo utilizzo all’interno del complesso dell’opera weberiana.
